YUCOM on Constitutional Change: Courts Improved, Prosecution Offices Not

Changes to the Constitution of Serbia in the area of judiciary “will introduce certain improvements when it comes to courts, but the problem is that persons elected on a political basis will stay at the Prosecutorial Council, the director of the Lawyers’ Committee for Human Rights (YUCOM), Katarina Golubovic, said on Dec. 1.

Golubovic explained for the Nova paper that the new solutions might pave the way to reducing  the influence of politics on the judiciary, but she wasn’t sure it would actually happen, because political nominees remained at the Prosecutorial Council of Serbia.

“The supreme public prosecutor is a political figure affecting decision making. The justice minister, elected by the Parliament, stays at the Council as well,” Golubovic has cautioned. According to her, “prominent lawyers” will be appointed to the body after they had been elected by the Parliament, and it appears that they will also “form a majority.”

The YUCOM director added that the situation in courts was different, explaining that the president of the Supreme Court will not be elected by the Parliament. “The Supreme Council of Judiciary will include six judges and four prominent lawyers, and the minister of justice will not be there. The solution is better compared to the existing one, and the Venice Commission’s recommendations have been respected in this segment,” Golubovic said.
