Serbian Bar Association against Skype Trials

The Bar Association of Serbia on March 30 expressed its opposition to holding trials via video link, more specifically Skype, describing this as "a proceeding not envisaged by law" and "a severe violation of the right of the accused to a fair trial."

Proceedings against persons charged with violations of self-isolation measures are currently being held using Skype in Serbia.

"This new institute was introduced into our criminal proceeding legislation with a simple memo from the Justice Ministry to courts," and that memo "cannot represent a sound foundation for implementation," the Bar Association stressed, adding that such measures would have to be "brought in legal procedure laid out in the Constitution and by the responsible bodies."

The Bar Association of Serbia expressed opposition to this form of trial, noting that it shared "the concern of Serbian citizens in light of this new situation" and that it was "giving its contribution with proposals, donations and doing its job in conditions dangerous to health and life."
