Kurti Tells Thaci He Had Violated Kosovo's Constitution

The leader of the Self-Determination Movement, Albin Kurti, stated on April 22, in response to the letter of Kosovo President Hashim Thaci and his meeting with leaders of the parliamentary parties of Kosovo, that the president was violating the Constitution of Kosovo with his behavior, because his party had not yet refused to nominate the new premier designate.

"In spite of the fact that we have in no way refused the request to nominate the designate, I received a letter from you on April 22, 2020, in which you concluded, outside of your constitutional authority as president, that I have not used the right to nominate the new premier designate. The Constitution of Kosovo does not envisage authorization for the president to assess or make conclusions about the using or non-using of the right to nominate the designate," Kurti wrote in the letter.

He stressed that the Constitution and the ruling of the Constitutional Court from 2014 do not define the deadline for the nomination. "What the Constitution does envisage in this case is the defining of the designate only after the party with absolute or relative majority in the assembly nominates a candidate, as defined in item 84 of the ruling of the Constitutional Court," Kurti wrote.

In his fifth letter to the president of the Self-Determination and outgoing premier, Albin Kurti, Thaci wrote that Kurti had not used the right to name a candidate to be the new designate premier of Kosovo, after the government was ousted by a no-confidence vote on March 25.
