Prosecutor: High Prosecutorial Council No More Independent Than Before Judicial Reforms

Rather than passing decisions based on debate and the contrast of different opinions, Serbia’s High Prosecutorial Council is clearly operating under external mandates, said public prosecutor Goran Ilic of the Supreme Public Prosecutors’ Office, adding that the situation is the same as it was before the 2022 constitutional reform targeting the judiciary.

“I’m especially surprised by the Council’s decision to continue the ongoing election of head public prosecutors while completely ignoring the new regulations and the spirit of the constitutional changes, as announced by the National Convent on the EU,” Ilic told the June 26 edition of the Politika daily.

Asked what his assessment is based on, the prosecutor stated that the evidence of external influences is inferential, but that one can also analyze the content of the body’s decisions so far.

“It’s clear that anyone disliked by a single member of the public prosecution has no chance of being elected,” he explained. “It’s as if expertise and competence are completely irrelevant.”

According to him, last year’s amendments to the sections of the Constitution pertaining to the judiciary and the new Law on Public Prosecution which has been in effect for just over a month “woke the public prosecution from seven decades of slumber,” but neither are all the solutions good nor can Serbia’s prosecution immediate become independent and responsible. 

The 2022 changes to Serbia’s Constitution were part of the pre-accession process for joining the European Union.
