Higher Court’s Decision on Nationwide Lawyer Strike Is Problematic, Says Lawyer Sabic

Lawyer Rodoljub Sabic on Jan. 21 said that the Belgrade Higher Court’s decision on the attorneys who have gone on strike was problematic for several reasons, adding it was contributing to undermining the legal system and served to delude the public.

The Higher Court in Belgrade announced on Jan. 20 that it had partially overturned a decision made by the Assembly of the Serbian Bar Association to completely stop providing services. Consequently, the Serbian Bar Association has decided to go on a three-day strike.

According to Sabic, what is disputed is the Higher Court’s competence in this case, as “two years ago, deciding on a complaint against the Serbian Bar Association for suspending work in late 2021, the court dismissed the complaint, saying it has no competence in the case.”

“The court has adopted a proposal to order an interim measure within only a few hours from the moment the complaint was filed, which is far from any similar precedent in court practice. Being so hasty, the court ordered an interim measure, while ignoring its legal obligation to give the other party the opportunity to present its case,” Sabic said, stressing that it actually represented violation of the civil action principles.

Earlier, the Serbian Bar Association decided to fully stop work across Serbia from Jan. 20 to 26, in support of protesting university students and their demands.
